Terms & Conditions


**1. Enrolment:**  

1.1 By enrolling in the Early Explorers Classes, participants agree to abide by the following terms and conditions outlined below. This agreement is between the Directors of the class and the participants.  


**2. Eligibility:**  

2.1 Participants must be a parent or legal guardian or have expressed permission from them to attend with their child aged from birth to 5 years unless otherwise agreed with the Directors.   


 **3. Registration and Payment:**  

3.1 Participants must complete the registration process and pay the specified class fee to secure their spot. Payment can be made via the methods provided by the Director.  

3.2 The price of the Services (which includes VAT where applicable) will be the price indicated on our website. The price you have been charged will be shown on your order confirmation. 

3.3 We will inform you of what payment methods we can accept and when you must pay for the Services at the time of placing your order. Your payment will be held securely and will not be processed until we accept your order. Payment for our Services must have been made in full as agreed between you and us before we provide any of our Services to you. 

 

**4. Class Schedule:**  

4.1 Participants are required to attend classes on the specified dates and times as communicated by the Director. Any changes to the schedule will be communicated in advance.  

4.2 Class leaders will take a register of expected participants at the beginning of each class. Anyone unexpected will be asked for identification. 

 

**5. Health and Safety:**  

5.1 It is the responsibility of the parent/carer to ensure that both themselves and their child are in good health and suitable physical condition to participate in the class activities.  

5.2 You must not bring your child to class if they have any contagious illness.

5.3 If you or your child have sickness and diarrhoea you must have been clear of all symptoms for at least 48 hours before attending any Early Explorers classes.

 5.4 You may be refused entry to your booked classes if class leaders believe that you or your child are not well enough to participate. 

 

**6. Conduct:**  

6.1 All participants are expected to conduct themselves in a respectful and considerate manner towards the teacher, other participants, and the class environment. 

6.2 Conduct and expectations are outlined at the beginning of a session. 

6.3 No outdoor footwear is to be worn during the class and socks must be worn.

6.4 The parent/carer of the child are responsible for their safety at all times.  

6.5 Please use designated nappy bins provided or take them home with you.

6.6 Class Teachers reserve the right to refuse entry to any person whose behaviour is unreasonable.  

6.7 Anyone not behaving in accordance with outlined expectations may be asked to leave the session.   

 

**7. Photography and Videography:**  

7.1 The Class Teachers may take photographs or videos during the class for promotional purposes. By participating, participants grant permission for the use of such media and to be posted on social media, unless requested otherwise. To opt out please email info@earlyexplorersharrogate.co.uk.  

7.2  You are welcome to take pictures or videos of your own children during classes, however please be mindful of taking photos of others without their consent.  

7.3 If there is a specific safeguarding risk or concern regarding any participant, you will be notified at the start of the session that no phones will be permitted. We ask that they remain in bags for the duration of the class so we can be certain that no photographs or videos are taken. Anybody breaching this term of contract will be required to delete any images immediately.  

 

**8. Cancellation and Refunds:**  

8.1 Refunds may be requested and will be determined at the discretion of the directors.  

8.2 Unfortunately, we are unable to rearrange missed lessons, however we would love for you to gift your place to a friend. If you want to pass your place on to someone else, please let us know at your earliest convenience. 

8.4 In the instance that a hall cannot be used in the short term, we will endeavour, where possible, to re-schedule your lesson. In this instance Early Explorers is not responsible for any travel expenses incurred. 

8.5 Online classes will be offered as an alternative in the event of another national lockdown due to Coronavirus.

8.6 In the event of local adverse weather preventing you from attending your class, unfortunately we cannot offer refunds or rescheduling.

8.7 In the event that the course is cancelled by the Directors due to unforeseen circumstances, participants will be notified promptly, and refunds or rescheduling options will be offered at the discretion of the Directors.  


**9. Liability Waiver:**  

9.1 Participants acknowledge that they are participating in the class voluntarily and at their own risk. Provided that we have performed our Services in accordance with our risk assessment and we have not breached the Contract, we will not be liable to you for any loss or damage you suffer as a result of attending our Classes (save where such an exclusion is prohibited by law). 

9.2 We are only responsible for loss and damage if we fail to comply with these terms. 

9.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Services including the right to receive Services which are as described and supplied with reasonable skill and care. 

9.4 We are not liable for your property. Please note that your property and belongings which you or your child bring to a Class are your responsibility and we shall not be responsible for any loss of, or damage to, such property. 


**10. Privacy:**  

10.1 Personal information collected during the registration process will be used for class-related communication and administrative purposes only. 

10.2 Early Explorers will record, process and keep your personal information secure in accordance with The General Data Protection Regulation. You have the right to request for your data to be corrected or removed at any time. To do so, please contact info@earlyexplorersharrogate.co.uk.  

10.3 Our class may utilise third-party services, such as online registration platforms or communication tools. These services may have their own privacy policies, and we encourage you to review them before using such services. 

10.4 When booking an Early Explorers class, you agree to joining our mailing list. Occasionally we send out emails to our customers with information about your classes. You can choose to unsubscribe from these emails at any time. To opt out please email info@earlyexplorersharrogate.co.uk 

10.5 The names and ages of participants are on a digital class register which the teachers will have at the class and therefore this data may visible to other users. 

10.6 Any electronic data sent to us is inputted at your own discretion. Please keep your password safe and confidential.

 

**11. Equal Opportunities** 

11.1 Early Explorers follows relevant legislation, to ensure equal opportunities for all children and families.

 

**12. Queries and complaints** 

12.1 If you have any questions, queries or complaints, please speak to your teacher who will do their best to address your concern. If you wish to discuss things further, please email the Directors at info@earlyexplorersharrogate.co.uk

 

**13 Other Important Terms** 

13.1 This Contract is between you and us. No other person shall have any rights to enforce any of its terms.  

13.2 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

13.3 If we are delayed in enforcing this contract or contacting you for breaking this contract, this will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Services, we can still require you to make the payment at another time. 

13.4 These terms are governed by English law and can bring legal proceedings in respect of the Services in the English courts. 


**14.  Our rights to end the contract** 


14.1 We may end the Contract for our services if you commit a serious breach (or repeated breaches) of these terms. 

14.2 If we end the Contract in the situations set out in clause 14.1 , we will refund any money you have paid in advance for Services we have not provided. However, we may deduct or charge you the reasonable administration costs incurred as a result of your breaking the Contract (such as for any materials we have procured to provide the Services to you). 


**15. Amendments to Terms and Conditions:**  

15.1 The Directors reserve the right to amend these terms and conditions. Participants will be notified of any changes and will have the option to accept or decline them. By enrolling in Early Explorers Classes, participants indicate their understanding and agreement to these terms and conditions.
